1. Service Description

Tune My Vibe, LLC offers users access to music and songs generated using third-party artificial intelligence (AI) music platforms. We sell downloadable tracks for personal and commercial use, subject to our License Agreement and compliance with applicable laws.

2. Age

You must be at least 18 years old, or the age of majority in your jurisdiction, to use our services. By using the website, you represent and warrant that you meet these requirements.

3. Account and Purchase

  • You may purchase music without creating an account, but some features may require registration.

  • You agree to provide accurate and complete information and to update your information as necessary.

4. Intellectual Property and License

  • All AI-generated music is produced using third-party AI platforms. Tune My Vibe retains rights only to the musical tracks offered for sale, not the underlying AI technology.

  • The lyrics in the tracks are a mix of original poems authored and copyrighted by Tune My Vibe, LLC and AI-generated or AI-modified lyrics. All rights to the original lyrics are exclusively reserved.

  • Your license includes use of the combined musical composition and lyrics, subject to the License Agreement.

  • You may not separately extract, reuse, or claim ownership of any original lyrics apart from the licensed Music tracks.

  • Your license to use each track is governed by our posted License Agreement and is limited to the rights explicitly described therein.

  • You may not resell, redistribute as-is, or use the music output for training other AI without explicit written permission.

  • The website and all related content, including text, logos, graphics, and branding, are the property of Tune My Vibe, LLC or its licensors.

5. Restrictions on Use

When using our site or music, you agree not to:

  • Violate any law or regulation.

  • Post or transmit infringing, defamatory, obscene, or otherwise objectionable content.

  • Attempt to reverse-engineer, de-compile, or disassemble any part of the website or provided outputs.

  • Interfere with, disrupt, or attempt to gain unauthorized access to our systems or other users’ accounts.

6. AI and Third-Party Platforms Disclaimers

  • Music is generated using third-party AI platforms over which Tune My Vibe has no direct control.

  • We make no guarantees that the music is unique, original, error-free, or immune from third-party claims.

  • Your right to use content may be affected by changes in third-party AI platforms terms or availability.

7. Pricing and Payment

Each song or track may have a different price depending on the intended use or license category. Current pricing is displayed at the point of purchase and may be updated at our sole discretion. Pricing examples include, but are not limited to:

Personal Use License: $1.49 per track (for non-commercial, personal enjoyment only).

Commercial Use License: $199.00 per track (for use in monetized videos, commercial projects, or business promotion).

Movie/Film Licenses:

  • Student/Festival Film License: $499 per track (for use in student films or films submitted to film festivals without broad commercial distribution)
  • Indie Feature/Short Film License: $1,499 per track (for independent film or short productions with limited theatrical, streaming, or digital release)
  • Major Motion Picture License: $4,999 per track (for wide-release, broadcast, or major studio productions)

  • Extended/Enterprise Licenses: Contact us for pricing (for broadcasting, resale, large-scale or specific commercial uses).

You are responsible for selecting the appropriate license and price tier for your intended use. Your rights to use the music are defined and limited by the specific license purchased and our License Agreement.

Fees are payable at the time of order via approved payment methods.

We offer no refunds. All sales are final except as required by applicable law.

EACH DOWNLOAD LINK IS VALID FOR ONE DOWNLOAD ONLY PER PURCHASED TRACK. YOU CAN DOWNLOAD YOUR PURCHASED TRACK IMMEDIATELY AFTER PURCHASE THROUGH THE ISSUED RECEIPT OR USING THE EMAILED LINK. THE LINK WILL EXPIRE UPON DOWNLOADING YOUR MUSIC FILE OR AFTER 24 HOURS, WHICHEVER HAPPENS FIRST. THIS IS NECESSARY FOR US TO DO TO PROTECT OUR ASSETS AND THE INTEGRITY AND SECURITY OF OUR WEBSITE, SERVICES, AND USERS. IT IS THE USER’S RESPONSIBILITY TO DOWNLOAD THE PURCHASED TRACK BEFORE THE LINK EXPIRES. PLEASE CHECK YOUR SPAM FOLDER IF YOUR DOWNLOAD EMAIL DOES NOT APPEAR IN YOUR INBOX. WE RECOMMEND THAT YOU BACKUP YOUR MUSIC FILES TO MULTIPLE DEVICES TO PROTECT YOUR PURCHASE.

8. Termination

We reserve the right to restrict or terminate access to our site or services at our sole discretion, including if you violate these Terms or our License Agreement.

9. Changes to Terms

We may update these Terms from time to time by posting a revised version on our website. Continued use of our site after changes become effective constitutes your acceptance of the updated Terms.

10. Warranty Disclaimer

ALL MUSIC IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. LICENSOR MAKES NO GUARANTEES THAT OUR SERVICES OR DIGITAL CONTENT AND DOWNLOADS WILL BE PERFECTLY COMPOSED OR GENERATED TO INDUSTRY STANDARDS, ERROR-FREE, SECURE, OR UNINTERRUPTED. LICENSOR MAKES NO GUARANTEES AS TO THE UNIQUENESS, MARKETABILITY, OR FORMAL COPYRIGHT REGISTRATION OF THE AI-GENERATED MUSIC.

11. Limitation of Liability

To the maximum extent permitted by law, Tune My Vibe, LLC and its officers, managers, owners, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of, or related to, your use of our website, services, songs, or music.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tune My Vibe, LLC and all of its officers, employees, and affiliates from and against any claim, loss, liability, demand, or expense (including attorney fees) related to your use of the website, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles.
