1. AI Platform Disclosure
All music offered by Tune My Vibe, LLC (“Licensor”, “us,” “our”) is created using third-party AI music generation platforms. Tune My Vibe does not own or control the underlying AI technology but is authorized to license commercial usage of musical output produced during its active membership or license term with said third-party platforms.
2. Grant of License
Licensor grants the purchaser (“Licensee”) a perpetual, worldwide, non-exclusive, royalty-free license to use, monetize, broadcast, publicly perform, adapt, create derivative works from, and sub-license the AI-generated musical tracks and accompanying lyrics (“Music”) acquired from www.tunemyvibe.com, subject to the license tier purchased.
License tiers include, but are not limited to:
Personal Use License: $1.49 per track (for non-commercial, personal enjoyment only).
Commercial Use License: $199.00 per track (for use in monetized videos, commercial projects, or business promotion).
Movie/Film Licenses:
- Student/Festival Film License: $499 per track (for use in student films or films submitted to film festivals without broad commercial distribution)
- Indie Feature/Short Film License: $1,499 per track (for independent film or short productions with limited theatrical, streaming, or digital release)
- Major Motion Picture License: $4,999 per track (for wide-release, broadcast, or major studio productions)
- Extended/Enterprise Licenses: Contact us for pricing (for broadcasting, resale, large-scale or specific commercial uses).
Licensee is responsible for selecting the appropriate license tier matching their intended use at purchase time. Rights and restrictions are defined and limited by the specific license purchased.
Licensee acknowledges:
- The musical tracks are AI-generated and may or may not qualify for traditional copyright protection, depending on the significance of the added human authorship.
- The lyrics contained in the tracks are a mix of original poems authored and copyrighted by Tune My Vibe, LLC and AI-generated or AI-modified. All rights to the original lyrics are exclusively reserved by Licensor.
- Licensee’s rights to use the Music extend only to the scope granted by the purchased license and do not transfer ownership or exclusive rights of the original lyrics.
- Licensee may grant sub-licenses only under terms consistent with this Agreement, ensuring no sub-licensed party may claim exclusive rights or separate out any original lyrics without written permission.
3. Copyright and Authorship Notice
The Music consists of two elements:
- AI-generated musical tracks, which may not qualify for copyright protection in some jurisdictions.
- Lyrics that may include:
- Original poems and poetic lyrics authored and fully owned by Licensor (Tune My Vibe, LLC), protected as literary works (with all rights exclusively reserved by Licensor).
- AI-generated or AI-modified lyrics, which may not be eligible for traditional copyright protection unless combined with significant human authorship.
Licensee may use the combined Music as permitted under this Agreement, but Licensor retains, at all times, exclusive ownership of any original lyrical content it has created.
4. Attribution
Attribution is not required but appreciated:
“AI-generated music by Tune My Vibe – www.tunemyvibe.com”
5. Usage Restrictions
Licensee shall not:
- Claim ownership, authorship, or exclusive rights to any original lyrics authored by Licensor.
- Separate, extract, modify, or use any original lyrics apart from the combined Music track without explicit written permission from Licensor.
- Use the Music for unlawful, infringing, defamatory, or otherwise harmful purposes.
- Offer the Music as “exclusive” unless a separate, express exclusive license is granted.
- Use the Music for training, developing, or improving any AI models or datasets, without explicit written permission.
- Use the Music beyond the scope, territory, or limitations permitted under the purchased license tier. Licensee agrees to upgrade the license if intended use changes.
6. Third-Party Platforms Terms
Licensee’s rights depend on Licensor’s ongoing authorization from the third-party AI platforms. If Licensor’s rights to distribute the Music are suspended or revoked, this License may also be suspended or revoked. Licensor will notify Licensee of any relevant changes.
7. Warranty Disclaimer
ALL MUSIC IS PROVIDED “AS IS,” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. LICENSOR MAKES NO GUARANTEES THAT OUR SERVICES OR DIGITAL CONTENT AND DOWNLOADS WILL BE PERFECTLY COMPOSED OR GENERATED TO INDUSTRY STANDARDS, ERROR-FREE, SECURE, OR UNINTERRUPTED. LICENSOR MAKES NO GUARANTEES AS TO THE UNIQUENESS, MARKETABILITY, OR FORMAL COPYRIGHT REGISTRATION OF THE AI-GENERATED MUSIC.
8. Indemnity
Licensee agrees to indemnify, defend, and hold harmless Licensor and all its officers, employees, and affiliates from all claims, damages, losses, or liabilities arising from Licensee’s use, sale, sub-license, or public performance of the songs or Music.
9. Severability
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions will remain in full effect.
10. Governing Law
This Agreement is governed by the laws of the State of California, USA, without regard to conflict of laws principles.
11. Acceptance
By purchasing or downloading Music from www.tunemyvibe.com, Licensee agrees to these terms and acknowledges the AI-generated nature of the Music, Licensor’s exclusive ownership of the lyrics, and license restrictions by tier and usage.
